Kahaani (“Us”, “We”, or “Platform”) is committed towards respecting and protecting your privacy. This Privacy Policy (“Policy”) outlines how we collect, use, and safeguard your information or personal data when you use Kahaani. By using Kahaani, you agree to the terms of this Privacy Policy. To the extent that you a minor (individual under the age of 18 years) under the applicable laws, please ensure you read this Policy in the guidance and presence of a Parent or Legal Guardian, we shall provide services to a minor only upon receiving such consent from a parent or legal guardian at contact@kahaani.app. 

1. Information We Collect

1.1 User-Provided Information

• Email Address: We use Google Firebase to facilitate user authentication, it collects email addresses solely for identification purposes. This information will never be used for communication or any other purpose without your explicit consent.

• Device ID: A user's Device ID, used to access the app, undergoes a one-way hash before being stored on our backend servers. This information is irreversibly encrypted, hence, it is clarified and informed that the developers cannot access it, and we will never use it for communication or any other purpose unless we obtain a consent from you.

1.2 Automatically Collected Information

When you use Kahaani, we collect certain information about your interactions, including but not limited to:

• User actions performed within or on Kahaani (e.g., clicks on buttons, usage of AI features).

• Reading activity/trends of users (e.g., number of pages read, last book access timestamp).

• Usage metrics to improve the functionality and user experience of Kahaani.

User interactions are anonymized and not associated with a user account.

2. How We Use Your Information

We use the information we collect to:

• Provide and improve Kahaani’s features, operationality and functionality.

• Store your book content and associated interactions, to allow you to resume from your last read page.

• Empower AI-powered features such as creating book summaries.

• Monitor app performance and usage trends.

• Respond to user inquiries and provide customer support.

3. Data Retention and Deletion

• User data including associated book content are stored on our backend systems and deleted after 90 days of inactivity.

• You can request the deletion of your account and all associated data in the app itself by going to the info screen and scrolling down and pressing the “Delete Account” button, availing this option shall immediately restrict Kahaani from accessing or processing all or any forms of information collected from you. 

• In the instance Kahaani retains your information beyond the timeline stated above, all your personal information and identifies shall be anonymised before retaining such information, provided such anonymization is prohibited under an applicable law. 

4. Data Sharing

We do not sell, share, disclose, broker, rent, or trade your personal information with any other organization or third party service providers for commercial purposes or otherwise. Your data may be shared only in the following circumstances:

• Legal Requirements: We may disclose information if required by any applicable law or to protect our legal rights.

• Data Processors: We do not share all or any forms of Information collected from you with any third-party service providers or data processors. 

5. User Data Protection Rights

Depending on your jurisdiction, you may have the following rights:

• Access and Correction: Request access to information regarding processing of your information or personal data.

• Right to Correction: Request correction of inaccurate or inconsistent data

• Right to Deletion: Request deletion of your personal data.

• Withdraw Consent: Request withdraw your consent to data processing at any time during the processing.

• Right of Grievance Redressal: Raise queries or grievances in regard to processing of your information by Kahaani.  

• Right to Nominate: Right to nominate another data principal to act on your behalf in the instance of your incapacity or death.

6. Security Measures

We use reasonable administrative, technical, organizational and physical safeguards to protect your data from unauthorized access, disclosure, or misuse to ensure the confidentiality, integrity and availability of your information. However, no security system is completely secure, and thus we cannot guarantee absolute security.

Kahaani uses Firebase to provide secure user authentication options, including Google Login and Email Login. The following measures are in place to ensure user data and credentials remain protected:

1. Encrypted Communication: All communication between the app and backend servers is encrypted using HTTPS, ensuring data is transmitted securely and cannot be intercepted by unauthorized parties.

2. Secure Password Storage for Email Login: For users logging in with email, passwords are securely stored using advanced cryptographic hashing techniques. This ensures that stored passwords cannot be reverse-engineered or accessed in plain text, even in the unlikely event of a breach.

3. Google Login Security: For users choosing Google Login, Kahaani relies on Google’s authentication systems. These systems are designed with industry-leading security measures, providing a robust and trusted method for verifying user identities.

4. Ongoing Security Updates: Kahaani benefits from Firebase’s regular updates, ensuring that authentication systems are continuously enhanced to address emerging threats and vulnerabilities.

These measures reflect Kahaani’s commitment to protecting user data and maintaining the highest standards of security and privacy.

7. Cross border data transfer

Upon your express consent, your personal data may be transferred to and processed in countries outside your residence. We ensure such transfers comply with applicable data protection laws and provide appropriate safeguards to protect your data, however we shall not undertake any forms of cross-border data transfer to regions/nations restricted by the Central Government or any other restrictions under any applicable laws.

8. Tracking and Analytics

As a mobile application, Kahaani does not use cookies. However, we may collect and process aggregate usage data, such as user activity and interactions, to improve functionality and user experience. This information is collected through internal tracking mechanisms within Kahaani.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time or upon changes in applicable laws. We will notify you of significant changes through Kahaani. Continued use of Kahaani after changes are posted constitutes your acceptance of the updated Privacy Policy.

Legal Terms and Conditions

Thank you for using Kahaani. These terms and conditions govern your use of Kahaani. By accessing or using Kahaani, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the app.

1. Purpose of Kahaani

Kahaani is designed to help users read books and enhance their reading experience through AI-powered tools such as content summarization. Users can upload or access books, and Kahaani provides features to assist with reading and promote the work of authors. Kahaani does not provide access to book content unless uploaded or provided by the user.

2. User Responsibility for Book Content

Users are solely responsible for ensuring they possess a legal copy of any book they upload or access through Kahaani. Kahaani does not verify the ownership or legality of uploaded content. Any copyright infringement resulting from the use of unauthorized or pirated book content is the sole responsibility of the user.

Kahaani and its developers disclaim any liability for copyright violations arising from the user’s actions.

3. Data Storage and Privacy

3.1. Logged-In Users

• Kahaani stores book content and user interactions on its backend systems. Book content is deleted after 90 days of inactivity.

• This data is associated with the logged-in user’s account and is accessible only by the user through their account credentials.

• Kahaani implements appropriate measures to secure user data; however, it is the user’s responsibility to maintain the confidentiality of their login credentials.

3.2. Users Not Logged In

For users not logged in, no data is stored by Kahaani.

4. AI-Powered Features and Content Rights

4.1. Content Summarization

Kahaani uses artificial intelligence to summarize book content provided by the user. These summarizations and other AI-generated outputs are designed solely to assist with reading and promote the original author’s work.

4.2. Ownership of Content

• All rights to the original book content remain with the original author or copyright holder.

• The rights to any summarizations or AI-generated content derived from the book also belong exclusively to the original author or copyright holder.

• Kahaani does not claim any ownership or legal rights over any uploaded or generated content.

• The user shall hold Kahaani harmless and shall indemnify Kahanni against all or any legal actions arising out the misconduct or ignorance of the user. The user shall not hold Kahaani liable for all or any actions resulting from the user's use of Kahaani. 

5. Prohibited Activities

When using Kahaani, you agree not to:

1. Upload or share content for which you do not have the necessary rights or permissions or content prohibited under applicable laws.

2. Use Kahaani for unlawful activities, including but not limited to copyright infringement.

3. Attempt to reverse engineer, tamper with, or exploit Kahaani’s AI features for unintended purposes.

4. Claim Intellectual Property Rights over any work or content created or generated by the use of Kahaani.

6. Disclaimer of Warranties and Limitation of Liability

Kahaani is provided on an "as-is" basis without warranties of any kind, express or implied, except as required by applicable laws. While Kahaani strives to provide accurate, reliable, and functional AI-generated summaries and features, no guarantees are made regarding their accuracy, completeness, or reliability.

To the maximum extent permitted by applicable Indian law, Kahaani and its developers shall not be liable for any damages arising from the use of Kahaani, including but not limited to direct, indirect, incidental, or consequential damages. This limitation does not apply to damages resulting from gross negligence or willful misconduct or any other liability that cannot be excluded under Indian law.

7. Termination

Kahaani reserves the right to terminate or suspend access to Kahaani at its sole discretion, without notice, for violations of these Terms or any other reason.

8. Changes to the Terms

Kahaani reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of Kahaani constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be resolved in the courts of Delhi, India.
